What is a Warranty Certificate?
A Warranty Certificate is a document that commits the manufacturer or importer of a product to repair faults that appear during a defined period, or, where repair is not possible, to replace the product with a new one or refund the price. It transfers obligation onto the producer and importer and gives the consumer a concrete assurance. The warranty period must be at least two years.
Formally, the Warranty Certificate is the official document issued by the manufacturer, producer, or importer for the goods they sell, produce, or import, under which they commit to replace the product free of charge with a new one, repair it, refund the price, or reduce the price, within the warranty period of at least two years (or a measurement unit specific to the product's nature), in the event of a fault. The certificate also sets out the obligations of the seller and the consumer.
The regulation on Warranty Certificates tilts in the consumer's favor: manufacturers and importers are required to prepare a Warranty Certificate for the unused goods they produce or import for consumers. Without a Warranty Certificate, these parties face joint and several liability. The consumer can exercise their repair rights against both the manufacturer and the importer, and the regulation makes the seller, manufacturer, and importer jointly responsible for honoring those rights.
